    Dear Members,

    You may be aware that since February 2012 many Romanian nationals with Irish citizen children are facing lengthy delay's in receiving a decision on their application's for Irish passports. The Passport Office claim that a review is being undertaken by the Department of Justice and Equality.

    We can confirm that today we have been granted leave from the High Court to challenge the Passport Office's refusal to issue our client's child with a decision on their Irish passport application despite the fact that he was lawfully resident in Ireland for more than 3 out of the previous 4 years prior to the birth of his child.

    We will endeavor to keep you up to date with any further developments. We sincerely hope that these proceedings will help all those other Romanian parents who have been waiting so long for a decision on their applications.

    If you have been waiting for a decision on your passport application for your child then please contact us and we will assist you in receiving a decision from the Passport Office.

      Press Release 20/12/2012

      Dear Members,

      We are pleased to announce that following an Interim hearing in The High Court on 30 November 2012, the Passport Office have now issued a passport in respect of one of our client's. Furthermore we understand that following the pressure put on the Passport Office in light of the High Court proceedings initiated in our two cases, a Departmental review has now been completed and decision on all outstanding passport applications in respect of Romanian national parents will issue in the next few weeks. This is fantastic news for the Romanian Community and is further evidence of our continued efforts to ensure that Romanian nationals are treated equally and in a non-discriminatory manner.

            UPDATE:

            Dear Members,

            We can confirm that after 7 months of legal arguments in and outside the High Court we have obtained Irish passports for the children of both of our Romanian clients who were the subject of these Judicial Review proceedings.

            The only outstanding issue is how much compensation, if any, our client's should receive for the pain and suffering caused by the delay in issuing their children with passports. This issue will be heard before the President of the High Court in June of this year.

            In other news, we have taken Judicial review proceedings in the High Court against the Dept of Social Protection who refused to grant our client Jobseekers Allowance on the basis that after he ceased his self employment he lost his right to reside in the State. Our client was self employed for 4 years. We are seeking for the matter to be referred to the European Court of Justice for a decision. The matter was heard recently over three days in the High Cour and we expect to have a further update in June.
