Position in relation to Nationals of Bulgaria and Romania


The Government announced on Tuesday 24th October 2006 that it would continue to restrict access to the Irish labour market for nationals of Bulgaria and Romania following their Accession to the EU on the 1st January 2007.

Accordingly Bulgarian and Romanian nationals, will continue to require a permit to take up employment in Ireland and the job will continue to be subject to the current requirement for a labour market test. However those who are already in the State on a valid employment permit for an uninterrupted period of 12 months or longer prior to the 31st December 2006 will not need an employment permit.

Employers will be expected to satisfy their labour market requirements from within the European Economic Area (EEA) in the first instance and if this is not possible
it will be necessary for them to give preference to Bulgarian and Romanian nationals ahead of non-EEA nationals.


I am resident in the State on a valid employment permit for more than 12 months – will I require an employment permit after the 31st December 2006?

No, nationals of Bulgaria and Romania who have been resident in the State as the holder of an employment permit for an uninterrupted period of 12 months or longer prior to the 31st December 2006 will not require a permit after the 1st January 2007.

I am resident in the State on a valid employment permit for more than 12 months – will my Spouse or Dependants require a work permit?

No, if your Spouse or Dependant has been legally resident in the State on the basis of being your Spouse or Dependent and you have had a valid employment permit for an uninterrupted period of 12 months or longer then they will not require a work permit.

However, if they enter the State after 1st January 2007 then they will require a work permit. Applications will be accepted on foot of a job offer from spouses or dependants provided some basic requirements such as minimum wage are satisfied but the applications will not require a labour market test i.e. advertising in the newspapers and with FAS.

I am resident in the State on a valid employment permit for less than 12 months – will I require a work permit after the 31st December 2006?

Yes, nationals of Bulgaria and Romania who are resident in the State as the holder of an employment permit for less than an uninterrupted period of 12 months or longer prior to the 31st December 2006 will require a permit after the 1st January 2007 to bring them up to an uninterrupted period of 12 months.

I am resident in the State on a valid employment permit for less than 12 months – will my Spouse or Dependents require a work permit?

Yes, if your Spouse or Dependent has been legally resident in the State on the basis of being your Spouse or Dependant, or if they enter the State after the 1st January 2007, and you have had a valid employment permit for less than an uninterrupted period of 12 months or longer prior to the 31st December 2006 then they will require a work permit for an uninterrupted period of 12 months.

I intend travelling to Ireland in the near future to live and find employment – will I require a work permit?

Yes, any national of Bulgaria and Romania who has not been resident in the State on a valid employment permit for an uninterrupted period of 12 months or longer before 31st December 2006 will require a work permit for an uninterrupted period of 12 months.

I am an employer – how can I ascertain whether a national of Bulgaria or Romania requires a work permit?

The onus is on every employer to satisfy himself/herself as to whether a foreign national requires an employment permit. Eu fac cele 12 luni in martie (working visa IT), sotia mea a venit aici in noiembrie anul trecut (are dreptul sa aplice pt un work permit...Spousal Work Permits Scheme). In martie dupe ce voi cumula cele 12 luni, va putea sotia mea sa munceasca fara sa fie nevoita sa aplice pt un work permit?

nu stim deocamdata.

nu s-au precizat detaliile, si asa cum spunea si Vasile Ungureanu, Departamentul de Justitie abia in zilele urmatoare isi precizeaza pozitia, iar DETE urmeaza acest traseu pentru categoriile dependente.

vom comunica deciziile sau informatiile primite pe forum.

trebuie sa asteptam dar sa ne si mobilizam in acest timp sa facem eforturi sa obtinem si celelalte drepturi

am scris si io la entemp anu trecut in decembrie dupa un mesaj pe aceeasi tema al lui luca; ca sa raspund lui katt, sunt intr-o situatie similara, iar raspunsul era ca o sa avem nevoie si de-acu inainte de work auth noi si spousii. e un fel de discriminare si asta ... adica ne-or impartit si pe cei care eram deja aici in doua: unii care au platit mai mult timp impozit decat altii. si acu sa fim seriosi: cati om fi de multi (inclusiv familiile) cei care avem mai putin de 12 luni legal lucrate in IRL la 1 ianuarie 2007?!?
da' na, cu prima ocazie cand am ocazia sa le intorc "favorul" o voi face ...

buna tuturor, de curand m-am decis sa emigrez din tara noastra frumoasa numita Romania. Impreuna cu prietena mea am decis sa incercam sa emigram in Irlanda. Din pacate, nu prea stim care e procedura, de unde sa incepem, in cine sa avem incredere, ce trebuie sa facem pentru a obtine permisul de munca, daca sa apelam la companii de recrutare sau sa incercam pe cont propriu. Pe siteurile de specialitate am gasit oferte de munca dar nu stiu daca aceasta este solutia cea mai avantajoasa pentru a pleca afara..... Daca stiti alte modalitati de a gasi un job in Irlanda, va rog sa-mi spuneti, deoarece as prefera sa plec din tara direct printr-o companie straina de recrutare, sau chiar direct prin angajator, fara a mai implica alti intermediari. Daca totusi nu exista alte solutii decat firmele romanesti, va rog sa imi dati exemple de firme prin care ati plecat si care stiti ca sunt serioase...acum ceva timp mi-am facut cont pe Infomunca, au multe joburi in strainatate, si de curand am primit o oferta tentanta de la ei...dar nu stiu ce sa fac....Va rog, cei care ati mai trecut prin asa ceva, ajutati-ma sa iau decizia corecta...

Daca ai o oferta tentanta ia - o cu amindoua mainile. Altfel ai nevoie de permis de munca si asta e mai complicat. Daca te uiti un pic pe forum gasesti cam toate informatiile necesare.
