(1) (a) Subject to subhead (5), the Minister may issue a long-term residence permit to a foreign national
who meets the standard eligibility requirements or the eligibility requirements set out in a relevant
statement of immigration policy (where the latter are more favourable).

(b) A long-term residence permit issued under paragraph (a) shall be valid for a period of 5 years and
shall be renewable on conditions.

(c) The validity of the long-term residence permit issued under paragraph (a) shall not be affected by
absence from the State of the holder for a continuous period of less than one year.

(d) Meeting the standard eligibility requirements or the eligibility requirements set out in a relevant
statement of immigration policy [does not of itself entitle] [shall not be construed as entitling] a
foreign national to a long-term residence permit.

(2) (a) The standard eligibility requirements referred to in subhead (1) are:

(i) subject to paragraph (b), that the person [is] [has been] lawfully present in the State for
periods totalling at least 5 out of the 6 years [prior to the time of application for a longterm
residence permit];

(ii) that the person is of good character;

(iii) that the person [is in a position to support]/[has during his or her presence in the State been
supporting] himself or herself and his or her dependants without recourse to State
supports;

(iv) such other requirements as may be prescribed [including a requirement that the person is
fully tax compliant, can demonstrate a reasonable competence for communicating in the
English/Irish language, has made reasonable efforts to integrate into Irish society etc.

(b) A period of residence in the State shall not be reckonable for the purposes of paragraph (a)(i) if:

(i) it is in accordance with a residence permit given to a foreign national for the purpose of
enabling him or her to engage in a course of education or study in the State,

(ii) it consists of a period during which the foreign national concerned was the holder of a
protection temporary residence permit under Head 26,

(iii) it consists of a period during which the foreign national concerned was entitled to diplomatic
immunity in the State,
or
(iv) [the foreign national concerned was granted permission to enter the State only for the
purposes of [an intra-corporate transfer] [carrying out his or her duties as an employee at an
Irish subsidiary of a [multi-national] company].]
