am urmarit discutiile pe aceasta tema.

Ordinul de deportare este o problema a Justitiei Irlandeze, si in afara unei proceduri juridice de revizuire a acestuia in High Court/Constitutional Court, nu discutam legalitatea acestuia pe care o credem in mare masura a fi legala (mai ales pentru Romania, ca fiind desemnata o tara sigura dpdv al libertatilor individuale - cu mici exceptii)

Chestiunea este modul in care acest ordin de deportare este executat de catre GNIB (in colaborare cu cativa "romanii" de ai nostri pe bani frumosi si acte de rezidenta) si ce urmeaza dupa.
Mai ales in ultima campanie strict impotriva romanilor, in primul rand o denigrare masiva in mass media (special RTE Prime Time, radio, ziare), fortarea usilor cu barosul (nu cred ca are de a face cu Dl. Barosso - de la UE), spargerea acestora si vandalizarea casei indiferent daca locuitorii unt sau nu acasa, apoi plecarea si lasarea acestor case la buna dispozitie a celor care au furat tot ce s-a gasit de valoare sau au facut un ban din vanzarea acestor bunuri apartinand muncitorilor romani deportati.

Acum, dorim ca toti cei care cunoasteti cazuri de abuz sau tratament cu tocul pistolului sau asemanatoare, sa le punem impreuna si sa facem o campanie strict importiva metodelor de executare a ordinelor de deportare.

Asteptam datele Dvs si vom actiona asa cum scrie in lege - orice abuz se pedepseste si se cere a fi reparat (financiar in acest caz).

PS> In acest moment exista peste 7500 de imigranti care au primit ordine de deportare in Irlanda incepand cu 1999 dar care nu au fost executate (probabil ca peste 1/3 sunt romani ???). Surce citate DoJELR spun ca habar nu au unde sunt aceste persoane desi cred ca multe s-ar fi intors in tarile de origine. :-\

Cred ca cel putin doua raspunsuri sunt absurde in poll, cum adica se incalca un drept constitutional?
daca e vorba de constitutia Irlandei, atunci e aiurea pentru ca nu se prevede nici un drept pentru cetateni straini in constitutie (toate prevederile se refera la cetatenii irlandezi) daca e vorba de constitutia romaniei, atunci e si mai aiurea, pentru ca statul Irlandez nu trebuie s-o respecte in nici un fel.
poate clarifici un pic ce vrei sa spui sa-ntelegem si noi

Pt Mr Roadrunner,

Exista o Conventie Internationala a Drepturilor Omului, a fost semnata la Haga de catre toate statele membre ale UE, iar Constitutiile nationale ale statelor membre se obliga a respecta si aceasta conventie. Iar daca nu stiai, legile comunitare au dreptul de a fi aplicate in statele membre chiar daca nu exista vreo lege interna care sa reglementeze regimul lor. Daca ai dubii, te poti informa la www.europa.eu.int sau www.europa.eu, daca nu intelegi ceva poti intreba, pt ca persoanele respective sunt foarte amabile si-ti vor raspunde.

Poate ne citezi si noua muritorilor de rand, fragmentul in care sunt mentionate drepturile celor care au cerut azil si le-a fost refuzat ca de acestia e vorba in subiectul de fata (si de executarea deciziei judecatorilor)
banuiesc ca te referi la decralatia universala a drepturilor omului, corect?

Ca sa nu cititi chiar toata directiva, la capitolul V, articolele 20 - 23, se trateaza exact tema deportarii. Daca nu se respecta.....exista Tribunalul Drepturilor Omului de la Haga, unde chiar se tine cont de fiecare caz in parte.

CHAPTER V

Return and measures after temporary protection has ended

Article 20

When the temporary protection ends, the general laws on protection and on aliens in the Member States shall apply, without prejudice to Articles 21, 22 and 23.


Article 21

1. The Member States shall take the measures necessary to make possible the voluntary return of persons enjoying temporary protection or whose temporary protection has ended. The Member States shall ensure that the provisions governing voluntary return of persons enjoying temporary protection facilitate their return with respect for human dignity.

The Member State shall ensure that the decision of those persons to return is taken in full knowledge of the facts. The Member States may provide for exploratory visits.

2. For such time as the temporary protection has not ended, the Member States shall, on the basis of the circumstances prevailing in the country of origin, give favourable consideration to requests for return to the host Member State from persons who have enjoyed temporary protection and exercised their right to a voluntary return.

3. At the end of the temporary protection, the Member States may provide for the obligations laid down in CHAPTER III to be extended individually to persons who have been covered by temporary protection and are benefiting from a voluntary return programme. The extension shall have effect until the date of return.


Article 22

1. The Member States shall take the measures necessary to ensure that the enforced return of persons whose temporary protection has ended and who are not eligible for admission is conducted with due respect for human dignity.

2. In cases of enforced return, Member States shall consider any compelling humanitarian reasons which may make return impossible or unreasonable in specific cases.


Article 23

1. The Member States shall take the necessary measures concerning the conditions of residence of persons who have enjoyed temporary protection and who cannot, in view of their state of health, reasonably be expected to travel; where for example they would suffer serious negative effects if their treatment was interrupted. They shall not be expelled so long as that situation continues.

2. The Member States may allow families whose children are minors and attend school in a Member State to benefit from residence conditions allowing the children concerned to complete the current school period.
