The European Commission has welcomed the judgment of the European Court of Justice in the case of Metock and Others v. The Minister for Justice, Equality and Law Reform delivered on July 25.

This judgment clarifies the rights of free movement of European Union citizens and their family members throughout the EU.

The European Court of Justice has ruled that, in the case of a married couple, irrespective of when and where the marriage took place and of how the spouse entered the host State, a non-European Union spouse of a citizen of the European Union can reside with that citizen in the European Union without having previously been resident in another Member State.

The Court reminded Member States that they may still refuse entry and residence to any citizen on the grounds of public policy, public security or public health, provided the refusal is based on an individual examination of the particular case. Member States may also refuse, terminate or withdraw the right of entry and residence in the case of abuse of rights or fraud, such as marriages of convenience.

European Court of Justice finds Ireland in breach of spousal rights

The European Court of Justice (ECJ) has upheld the rights of EU citizens and their non-EU spouses who wish to live together in Ireland and found the State in breach of EU law, in a ruling handed down in Luxembourg last Friday.


The ECJ held that Irish legislation was contrary to the EU Freedom of Movement Directive.

Irish legislation currently requires that an EU national and their spouse must have lived together in another EU Member State before coming to Ireland, a position the ICI has consistently argued was unlawful and causing enormous emotional and financial hardship for families.



About 1,500 people have sought information and support from the ICI on this issue alone over the past 18 months.

Totat povestea asta imi aminteste de o discutie care am avut-o cu un coleg de munca irlandez, can incercam sa-i explic ca la irlandezi cand le convine sunt in EU si cand nu le mai convine nu mai sunt in EU. Am impresia ca urmeaza altele ca cea de mai sus la orizont...
